Yes, you are!
If you were to remarry, and had not obtained an annulment, then you would have
an issue the Church would have to look into.
The issue is serious sin. You cannot approach Holy Communion unrepentant of
serious sin, and if you were married and living as a married couple, you
would be habitually committing serious sin and would not therefore be
eligible to receive Holy Communion.
If you had been married and, conscious of your
situation, had resolved to live with your husband as brother and sister as you
worked things out with your Confessor, then you would be able to receive Holy Communion.
It may take a long time to get an annulment. It depends on getting
information from your
ex-husband who may drift out of touch as time goes
on. If you ever hope to remarry or if that possibility is not ruled out
in your mind, it would be worth applying for the annulment now.
