Christopher Trigg wrote:

Hi, guys —

. . . and Good morning.

I was baptized and confirmed Catholic however I married a Lutheran in the Lutheran church.

The marriage ended and we were legally divorced. Since then, she has remarried . . . under what rights, I am uncertain.

My questions are:

  • Can I remarry in the Catholic Church this time?
  • and if I can, do I need an annulment?

Any help would be gratefully appreciated.

Many thanks,

Chris

  { Can a Catholic who married in another church remarry in the Catholic Church and is one needed? }

Paul replied:

Chris,

As a Catholic, your marriage in the Lutheran church to a Lutheran would not be valid. Therefore no annulment would be needed from the Catholic Church.

Nevertheless, contact your pastor for more details as to how to proceed.

Paul

Mary Ann replied:

Chris,

It depends.

  • Did you get a dispensation to marry in the Lutheran Church?
  • Were you a Catholic at the time, or had you left the Church?

Mary Ann

Chris replied:

Hi, Mary Ann —

No, I didn't get any dispensation. I have always been Catholic and never have renounced my faith. I don't know if that provides any further insight.

I wasn't in church every Sunday but as far as forms and decrees of separation from Catholicism, none were sought nor obtained.

Chris

Mary Ann replied:

Hi, Chris —

Without a dispensation, you marriage was invalid due to defect of form so a declaration of nullity (meaning an annulment) should be quite easy.

Mary Ann
