Hi, Jackie —

If you were married in the Church, divorced and remarried outside the Church, without first being granted a declaration of nullity for your first marriage, you may not receive Holy Communion.

The Church presumes the validity of the marriage until proven otherwise. I would encourage you to talk to your pastor about the possibility of starting the annulment process. There are no guarantees as a result of this process; it just means you wish the Church to investigate the validity of your first marriage.

As my colleague John stated in another posting:

For an annulment to be granted, there must be some pre-existing impediment or reason which would grant a declaration of nullity. Two such reasons are:

  • Emotional immaturity, the most common, and
  • failure to understand the nature of marriage.

If you receive a declaration of nullity, you can then get your current marriage convalidated and you can then receive Holy Communion.
