Hi Michele,

First of all, let me suggest to you that the two of you should not be living together unless and until your marriages are annulled. Having said that, let me address your question.

Any person can baptize another as long as the form, matter and intent is correct.  He *can*, baptize your niece, but *shouldn't* (except in danger of death).

If he does, he is to inform the pastor of the parish in the area where the Baptism was administered so it can be properly recorded.

It would be better if your niece was baptized in the Church by a priest, but if an emergency arose, any person, even one who is not baptized, can perform the sacrament.

If your niece (is/was) not in an emergency, then baptismal classes for the [parent(s)/guardian(s)] should be undertaken.
