Dear Jackie,
The status of the priest does not make a difference. The sacrament of marriage is actually conferred by the two persons who are becoming spouses to each other. The priest, in effect, is only a witness.
Your annulment will be contingent upon some defect in the sacrament, i.e., imperfect consent.
If you or your husband did not give full consent to the marriage, by virtue of:
- immaturity
- mental health
- youth
- duress
- not being open to children
- etc.
it would be considered nullable.
Best wishes,
Bob Kirby
