Andrew Shadows wrote:

Hi, guys —

My wife has applied for an annulment from her first husband. Our diocese has given us a positive response but it has also been sent to another diocese for approval.

We have not received any response from the second diocese but just found out my wife's first husband has recently passed away.

  • Do we still have to pursue an annulment?

Fr. Jonathan replied:

Dear Andrew,

Although she is now free to marry because the bond no longer exists, the case at that point would be completed.

If there is somehow a restriction placed on your wife it could still delay things for your marriage in the Church. Only a small percentage of cases in most Tribunals fall into this category.

Call the first diocese and make them aware that your wife's first husband has passed and I am sure they will inform the second diocese.

Fr. Jonathan
