Katherine wrote:

Hi, guys —

My daughter (never married) is marrying a man who is divorced with children; both are Catholic.

  • Can they be married by a Catholic priest, not necessarily in the Church, but at the hall?

Katherine

  { Can my Catholic daughter, who hasn't been married, marry a divorced Catholic man with children? }

Paul replied:

Katherine,

If the man's marriage was valid then your daughter cannot get married with a Catholic priest present as a witness, until or unless the man's previous union is declared null and void. Without a Church annulment, the previous marriage must be presumed valid, and any union between your daughter and the man would objectively be adulterous.

If the man's marriage was not a Church wedding and was proved to be invalid then it is possible that a priest may bless the wedding. Contact the parish priest to figure this out.

Paul

Mary Ann replied:

Katherine,

No, not without a declaration of nullity of his first marriage.

Otherwise, the priest would be officiating at a bigamous union.

Mary Ann

John replied:

Hi, Katherine —

Not only can't a priest marry them, but she cannot marry this man unless he gets an annulment.

If she goes ahead with the marriage anyway, she will be in a state of adultery and may not receive the sacraments including Holy Communion at Mass. She is putting her soul in grave danger.

John
